Terms and Conditions Effective Date: March 13, 2026

These Terms and Conditions (“Terms”) govern your access to and use of the website hugspil.is (the “Website”), our digital products, services, content, apps, downloads, subscriptions, or any related offerings (collectively, the “Services”) provided by TORI EHF (“we”, “us”, “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

We act as the provider under Icelandic law.

2. Eligibility

You must be at least 16 years old or have parental/guardian consent if under 16. If the Services are intended for children, separate age rules apply (we do not knowingly target children under 16 without safeguards). By using the Services, you represent that you meet these requirements.

3. User Account

Some Services require creating an account. You agree to:

  • Provide accurate, current information.
  • Maintain the confidentiality of your login credentials.
  • Notify us immediately of unauthorized use. We reserve the right to suspend or terminate accounts for violations.

4. License to Use Services

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes (unless otherwise stated), subject to these Terms. This does not include rights to:

  • Copy, modify, distribute, sell, or lease any part of the Services.
  • Reverse engineer, decompile, or extract source code.
  • Use the Services for illegal or unauthorized purposes.

All content (text, graphics, logos, software, digital products) is owned by us or our licensors and protected by copyright, trademark, and other laws.

5. Purchases and Payments

  • Prices are in ISK and include VAT unless stated otherwise.
  • Payment is processed via secure third-party providers. We do not store full payment card details.
  • By purchasing, you agree to pay all charges, including taxes and fees.
  • Subscriptions auto-renew unless cancelled. Cancellation takes effect at the end of the current period.

6. Right of Withdrawal (Cooling-off Period)

As a consumer in the EEA/Iceland, you have a 14-day right of withdrawal for distance contracts, subject to exceptions (see our Refund and Returns Policy for full details, including loss of right for instant digital content with your prior consent and acknowledgment).

7. Intellectual Property

All rights in the Services and content remain with us or our licensors. You may not use our trademarks, logos, or content without permission.

User-generated content: By submitting, you grant us a worldwide, royalty-free license to use, modify, and display it in connection with the Services.

8. User Conduct

You agree not to:

  • Violate laws or third-party rights.
  • Transmit viruses, malware, or harmful code.
  • Harass, spam, or impersonate others.
  • Interfere with the Services’ operation. We may remove content or terminate access for violations.

9. Digital Content and Services – Conformity and Guarantee

Digital content/services must conform to the contract (as described, functional, interoperable). You benefit from the 2-year legal guarantee under Icelandic/EU law for lack of conformity (remedies: bring into conformity, price reduction, or termination/refund — see our Refund and Returns Policy).

10. Limitation of Liability

To the maximum extent permitted by law:

  • Services are provided “as is” without warranties of any kind.
  • We are not liable for indirect, incidental, consequential, special, or punitive damages (e.g., loss of data, profits, business interruption).
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim (or 10.000ISK if no payment). Nothing limits liability for death/personal injury caused by negligence, fraud, or mandatory consumer protections.

11. Indemnification

You agree to indemnify us against claims arising from your breach of these Terms or misuse of the Services.

12. Termination

We may suspend or terminate your access for breach of these Terms, illegal activity, or at our discretion (with notice where required).

13. Changes to Terms

We may update these Terms. Changes are posted here with a new effective date. Continued use constitutes acceptance. Significant changes may be notified via email or Website notice.

14. Governing Law and Dispute Resolution

These Terms are governed by Icelandic law. Disputes shall be resolved in the courts of Reykjavík, Iceland. As a consumer, you may also use the European Online Dispute Resolution platform or contact Neytendastofa (Icelandic Consumer Agency).

15. Miscellaneous

  • Entire agreement: These Terms (together with Privacy Policy, Refund Policy, Cookie Policy) constitute the full agreement.
  • Severability: Invalid provisions do not affect others.
  • No waiver: Failure to enforce does not waive rights.
  • Assignment: We may assign these Terms; you may not without consent.
